This Service Agreement (hereinafter referred to as "this Agreement") is entered into between you and PESA INTERNET INDUSTRY CONSULTING COMPANY LIMITED (hereinafter referred to as "the Company" or "we"). This Agreement applies to all financial services provided by the Company's PesaX Pro product (hereinafter referred to as "the Product"). By registering, logging in, or using the Product, you agree to accept and comply with all terms and conditions of this Agreement.

1.1. User: Refers to any individual or legal entity who registers and uses the Product.

1.2. Financial Product: Refers to the financial services provided by the Company through the Product, including but not limited to loans and credit services.

1.3. Privacy Policy: Refers to the Company's policy on the collection, processing, use, and protection of user information. Please refer to the Company's published Privacy Policy for details.

1.4. Third-Party Services: Refers to services provided by third parties with whom the Company collaborates or authorizes to deliver services.

2.1. The Company provides the following financial services through the Product, including but not limited to:

2.2. The Company reserves the right to adjust, update, or change the scope of services according to actual circumstances and will notify the users via announcements or other appropriate methods.

3.1. The user must be a natural person over the age of 18 or a legally registered entity with full civil capacity within Tanzania.

3.2. The user warrants that all information provided (including but not limited to personal identity information, financial information, etc.) is truthful, accurate, and complete. Any legal liability arising from providing false information shall be borne by the user.

4.1. In the course of using the Product, the user shall strictly comply with Tanzanian laws and regulations and shall not engage in any illegal or infringing activities using the Product.

4.2. The user shall fulfill their repayment obligations in a timely manner according to the terms of the contract or agreement. In case of default, the Company reserves the right to take legal recourse.

4.3. The user is responsible for maintaining the security of their account and preventing unauthorized use or disclosure. The Company assumes no liability for security issues arising from the user’s negligence.

5.1. The user agrees that the Company may collect, store, use, and share their personal information in accordance with the Privacy Policy. The Company will take necessary measures to protect the user's data.

5.2. To provide financial services, the user’s identity information, credit evaluation data, and transaction data may be shared with authorized third-party credit institutions for identity verification and credit assessment.

6.1. If the user breaches this Agreement or any relevant laws and regulations, the Company has the right to terminate services immediately and reserves the right to pursue further legal action.

6.2. If the user fails to repay on time, the Company may take actions such as debt collection, reporting to credit bureaus, or legal proceedings to recover outstanding payments.

7.1. The Company reserves the right to suspend or terminate services in the following circumstances:

The user provides false information or engages in illegal activities;

The user breaches any terms of this Agreement;

If required by law or government regulations.

7.2. The user has the right to terminate this Agreement at any time by notifying the Company, but any outstanding debts or legal obligations must be fulfilled prior to termination.

8.1. This Agreement is governed by the laws of Tanzania.

8.2. Any dispute arising from this Agreement shall first be settled through friendly negotiation. If negotiation fails, either party may bring the dispute to the relevant court in Tanzania.

9.1. This Agreement becomes effective upon the user’s acceptance and use of the Product.

9.2. The Company reserves the right to modify this Agreement at any time, and the revised Agreement will be notified to users through announcements or other reasonable means. Continued use of the Product constitutes
